Bollywood film pirate gets three years in jail

ONE of Britain's biggest Bollywood film counterfeiters who operated from Southall has begun a three year prison sentence.

Yogesh Raizada, of Brookwood Road, Hounslow, was found guilty of nine charges under the Trade Marks Act and two charges under the Video Recordings Act for copying large numbers of Asian CDs, videos and DVDs at Isleworth Crown Court on September 17 last year .

And last week, after a three day confiscation hearing, a judge jailed Raizada saying he had made £471,857 from counterfeiting. A confiscation order was made for more than £160,000 of the cash.

Judge Lowen, summing up, told the court the offences were against the genuine manufacturer and the public. The crimes involved stealing from true copyright owners.

He said Raizada was clearly persistent in his trade and the offences were dishonest, pre-planned and within a sophisticated network.

During the trial the jury heard that Raizada had been seen by police passing items out of a van parked on Southall Broadway.

Police searched the van and found poor quality DVD and video cassettes, printed labels, cheques and money.

Raizada was arrested and his previous home address in Waye Avenue, Cranford, Hounslow, was searched. Officers found hundreds of blank video cassettes, a computer programmed to produce film titles for spine labels, a scanner, 30 video remote control units and counterfeit films.

Raizada told the court he had been the victim of circumstances.

He claimed he was walking along Southall Broadway on October 13, 2000 after shopping with friends standing by the van. He said when police officers approached the van his friends ran off. He claimed he had only driven the van to the police station to assist the officers. He also told the court he was a dealer of blank video tapes and the items found at his house were part of a negotiated settlement from his previous employer.

The prosecution was a joint investigation by Ealing Trading Standards officers and the Metropolitan Police who hailed the conviction a success.

Helen Wilkie, head of business regulation at Ealing Council, said: "This is a major victory in the war against music and video piracy and sends out a clear message. We will take legal action to protect businesses and consumers from counterfeit merchandise."

Issue of Protecting Business hass been addressed.

What about the issues of:

a) Poor Quality DVDs

and

b) Protecting the Customer against poor quality originals.
