Bollywood Entertainment Inc. of Sacramento is being sued for $120,000 by a self-described "superstore" for DVDs from India and other South Asian entertainment media, which says the local firm failed to display its advertising on and in some DVD cases as promised.
The suit, filed June 2 in Sacramento County Superior Court, says Maryland-based Nehaflix.com signed a contract with Bollywood in April 2003. Under that contract, Bollywood was to make copies of movies for Nehaflix to sell.
The pact was a private labeling agreement, in which Nehaflix's name and logo was to be featured on the front and back of DVD "clamshell" cases holding licensed copies of DVD movies, manufactured by Bollywood, the suit says. Preprinted promotional inserts were to be placed inside the cases, and Bollywood was to place "video inserts" prior to the start of the DVD movies, promoting Nehaflix as a movie sponsor.
Under a contract, Bollywood was to pay Nehaflix for its cost of printing the inserts with 100 "first-quality digital" DVD copies of each movie title packaged by Bollywood, the suit says. While the deal apparently went as contracted between April and August 2003, Nehaflix says that in September it found Bollywood was selling the printed DVD cases and inserts to Indiaweekly.com, Nehaflix's primary competitor. The suit contends Bollywood used an adhesive label with Indiaweekly's name and logo, pasted over Nehaflix's name and logo to conceal them.
The suit further alleges that Bollywood supplied Nehaflix with 5,000 DVD movies that were returned by customers as "inoperative or dysfunctional," and that Bollywood supplied Nehaflix with 8,000 DVD movies it believes are counterfeit or improperly licensed, and illegal to distribute. It seeks more than $120,000 in damages.
Calls to Sandish Mann of Bollywood, who is also a defendant, were not returned. A woman answering the phone at Bollywood said the company had no comment, adding, "We'll let our attorneys handle it."
