Any One Know about this??
--------------------

Bollywood Entertainment Inc. of Sacramento is being sued for $120,000 by a self-described "superstore" for DVDs from India and other South Asian entertainment media, which says the local firm failed to display its advertising on and in some DVD cases as promised.

The suit, filed June 2 in Sacramento County Superior Court, says Maryland-based Nehaflix.com signed a contract with Bollywood in April 2003. Under that contract, Bollywood was to make copies of movies for Nehaflix to sell.

The pact was a private labeling agreement, in which Nehaflix's name and logo was to be featured on the front and back of DVD "clamshell" cases holding licensed copies of DVD movies, manufactured by Bollywood, the suit says. Preprinted promotional inserts were to be placed inside the cases, and Bollywood was to place "video inserts" prior to the start of the DVD movies, promoting Nehaflix as a movie sponsor.

Under a contract, Bollywood was to pay Nehaflix for its cost of printing the inserts with 100 "first-quality digital" DVD copies of each movie title packaged by Bollywood, the suit says. While the deal apparently went as contracted between April and August 2003, Nehaflix says that in September it found Bollywood was selling the printed DVD cases and inserts to Indiaweekly.com, Nehaflix's primary competitor. The suit contends Bollywood used an adhesive label with Indiaweekly's name and logo, pasted over Nehaflix's name and logo to conceal them.

The suit further alleges that Bollywood supplied Nehaflix with 5,000 DVD movies that were returned by customers as "inoperative or dysfunctional," and that Bollywood supplied Nehaflix with 8,000 DVD movies it believes are counterfeit or improperly licensed, and illegal to distribute. It seeks more than $120,000 in damages.

Calls to Sandish Mann of Bollywood, who is also a defendant, were not returned. A woman answering the phone at Bollywood said the company had no comment, adding, "We'll let our attorneys handle it."

That explains why NX doesn't have the current BEi titles dvd. as for Bollywood dvd having "nehaflix" logo on it. i beleive i have "Dhaai Akshar Prem Ke" with that logo, but not "Sohni Mahiwal" that i recently purchased.

When speaking with BEi, they clearly stated that they only deal with IW and no longer with NX. I wonder when and with what title will they come back again should this case favour NX. It's a shame, such good dvd authoring company with such poor business ethic.

hey.. can NX not sue IW for put sticker on their logo. that would be fun

I wouldn't judge anyone based on charges from one side only.

Clipper... dont know whether they are lying or not. but they said "NX must be getting from different source not from BEi for sure".

Rana... who am i to judge; seems like this sueing stuff not happening to BEi for the first time.

by the way folks. how about IEi (Indian Entertainment Inc.) for the future DEi name.

:? :?

$ 120 K, less than one man year wages, will not scare any business into name change. Business name is worth more than $ 120 K.

Moreover, who knows how much counter claim will BEI have. Recall a few postings at the time of BEI-Nehaflix break-up, after a brief tie-up, where some one mentioned that the reason for break up was non payment from Nehaflix??

Who knows what's the truth. That's why I said, I wouldn't judge any one based on one side of the arguement.

But, the point was that Nehaflix link shows Sohni Mahiwal with Nehaflix advert.

the way i see it is that nx is probable crying sour grapes if what the article said was true namely.......... "The suit further alleges that Bollywood supplied Nehaflix with 5,000 DVD movies that were returned by customers as "inoperative or dysfunctional," and that Bollywood supplied Nehaflix with 8,000 DVD movies it believes are counterfeit or improperly licensed, and illegal to distribute. It seeks more than $120,000 in damages. " ........ any reputable company treated as such would want to distant themselves from a manufacturer that supplies them with inferior and pirated stuff moreover they would discontinue all that manufacturers stuff from their inventory... and furthermore if there is a lawsuit pending will suspend sales of all that manufacturers stuff until the suit is settled...... but of course thats if you are a reputable company and not one that readily deals with pirated stuff..... nx is like the case of the pot calling the kettle black

i feel silly responding.. but :?

i beleive the name change took place because DEi claimed bankruptcy. name change would take place should BEi claim bankruptcy again as a result. i thought that was obvious.

as far as nehaflix advert or logo is concern. you can find it on the following dvd covers:

http://store4.yimg.com/I/nehaflix_1798_4181958
http://store4.yimg.com/I/nehaflix_1798_4962925
http://store4.yimg.com/I/nehaflix_1798_2594194
http://store.nehaflix.com/golmaaldvd.html
http://store4.yimg.com/I/nehaflix_1801_6527350
http://store4.yimg.com/I/nehaflix_1798_4557530

the term "Nehaflix.com" on the following images (with different colors and fonts) isn't the actual logo or any advert on the dvd covers. they are simply placed on the images/scans; so other websites/individuals cannot use the image.

http://store4.yimg.com/I/nehaflix_1798_18987165
http://store4.yimg.com/I/nehaflix_1799_11944149
http://store4.yimg.com/I/nehaflix_1800_20398897
http://store4.yimg.com/I/nehaflix_1800_30778845
http://store4.yimg.com/I/nehaflix_1801_67556714
http://store4.yimg.com/I/nehaflix_1802_81264

and i thought that was obvious too. :!:
